TERMS & CONDITIONS - Be Elsewhere Ltd

These Terms & Conditions apply to all bookings made with Be Elsewhere Ltd (“Be Elsewhere”, “we”, “us”, “our”). By completing a booking, you agree to these Terms & Conditions.

1. About Us

Be Elsewhere Ltd provides curated residential walking weekends and related experiences as described on our website and booking materials. Travel to and from the experience location is not included unless explicitly stated.

2. Booking & Payment

2.1 A booking is confirmed once a 20% non-refundable deposit has been received and written confirmation has been issued by us.

2.2 The remaining balance is due no later than six (6) weeks prior to the experience start date.

2.3 If full payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit.

2.4 Payments are processed securely via Stripe. We may offer third-party instalment or “pay later” services (including Klarna). Where such services are used, you enter into a separate agreement with that provider and remain responsible for the full amount payable to Be Elsewhere Ltd.

2.5 All prices are stated in GBP and inclusive of VAT where applicable.

3. Cancellation by You

3.1 The 20% deposit is non-refundable.

3.2 If you cancel more than six (6) weeks before the start date, your deposit is retained and no further balance is due.

3.3 If you cancel between six (6) and four (4) weeks before the start date, 50% of the total booking cost is payable.

3.4 If you cancel within four (4) weeks of the start date, 100% of the total booking cost is payable.

3.5 If less than the applicable cancellation charge has been paid at the time of cancellation, the outstanding balance remains payable.

3.6 You may transfer your booking to another person at no additional charge, provided we receive their full details in advance and they agree to these Terms & Conditions. Responsibility for arranging the transfer remains with the original booking holder.

3.7 We strongly recommend appropriate travel insurance to protect against unforeseen cancellation.

Nothing in this section affects your statutory rights under the Consumer Rights Act 2015.

4. Cancellation or Changes by Be Elsewhere Ltd

4.1 We reserve the right to cancel an experience if minimum guest numbers are not met or in circumstances beyond our reasonable control, including but not limited to severe weather, property issues, safety concerns or force majeure events.

4.2 In such cases, you will receive a full refund of all monies paid to Be Elsewhere Ltd.

4.3 We are not liable for additional expenses incurred by you, including travel or related costs.

4.4 We reserve the right to make minor adjustments to accommodation, routes or schedules where reasonably necessary to ensure safety or quality of experience.

5. Accommodation & Conduct

5.1 Accommodation may be shared or private as stated at the time of booking.

5.2 Guests agree to respect the property, hosts, staff and other participants and are responsible for any damage caused.

5.3 We reserve the right to remove any guest whose behaviour is unsafe, disruptive or inappropriate. No refund will be provided in such circumstances.

6. Participation, Health & Responsibility

6.1 Our experiences involve walking and outdoor activity in natural environments, which may include uneven terrain, rural settings and changing weather conditions.

6.2 By booking, you confirm that you are physically and medically able to participate and accept responsibility for your own wellbeing during the experience.

6.3 You agree to disclose any relevant medical conditions, allergies or access needs prior to the experience.

6.4 All activities are optional and participation is voluntary.

7. Liability

7.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

7.2 Subject to this, Be Elsewhere Ltd shall not be liable for loss, damage or injury except where caused by our negligence.

7.3 We are not responsible for loss of or damage to personal belongings.

7.4 Where services are provided by third-party suppliers (including transport providers, chefs or activity providers), liability rests with the relevant supplier.

7.5 Our total liability shall not exceed the total amount paid by you for the experience.

8. Travel

8.1 Guests are responsible for arranging and funding their own travel to and from the experience location unless otherwise specified.

8.2 We are not liable for missed departures, travel delays or failure to attend due to transport disruption.

9. Photography & Media

9.1 We may capture photography or video content during the experience.

9.2 By attending, you acknowledge that such content may be used by Be Elsewhere Ltd for marketing and promotional purposes across digital and print platforms.

9.3 If you would prefer not to appear in any imagery, please let us know prior to or during the experience.

10. Complaints

10.1 Any concerns should be raised with us as soon as possible during the experience so that we have the opportunity to resolve them.

10.2 Formal complaints should be submitted within fourteen (14) days of the experience ending.

11. Force Majeure

11.1 We are not liable for failure to perform our obligations where such failure results from events beyond our reasonable control, including natural disasters, government restrictions, venue closure or other force majeure events.

12. Governing Law

12.1 These Terms & Conditions are governed by the laws of England and Wales.

12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
